Mediation & Resolution Strategy
A professional resource on preparing cases and clients for mediation, evaluating mediator fit, and approaching resolution as a litigation event—not merely a calendar event.
Preparation changes the mediation
Effective mediation begins well before the opening session. The parties need a realistic damages picture, a litigation-risk assessment, the right decision makers, a client who understands the process, and a plan for what happens if the matter does not resolve.
Core questions
- Is the case mature enough to mediate?
- What mediator style fits the dispute?
- What must the client understand beforehand?
- Which evidence needs to be developed before meaningful negotiation?
- What is the post-mediation litigation plan?
